Interplay between ADA, Workers Compensation, and the FMLA
These laws often create the Perfect Storm and don’t always play nice with each other. This program will focus on navigating the interplay of workers compensation, FMLA and the ADA. How these laws interact when it comes to the never-ending leave of absence, mental health issues and intermittent leave. “Reasonable” accommodations--when is enough … enough? We will take a more in depth look at these laws and provide practical solutions with real life examples. Through case examples, we will address those tough issues faced by HR and management as companies struggle with trying to accommodate the employee while at the same time doing what is in the best interests for the company.
Biographies:
Paul G. Klockenbrink is a Partner in the Roanoke, Virginia, at the law firm of Gentry Locke, LLP. Mr. Klockenbrink represents business clients in all aspects of the employment relationship including wage and hour laws, discrimination claims, return to work and noncompete/trade secret issues. He has successfully defended companies in jury trials covering a variety of employment issues. Paul regularly speaks and conducts training on various employment law issues. Mr. Klockenbrink chairs the firm's Hospitality and Restaurant Practice Group. He received his bachelor's degree from the University of Vermont and his J.D. degree from the University of San Diego.
Cate Huff practices in the Employment, Insurance, and Workers’ Compensation practice groups and has litigated in federal and state courts throughout Virginia. Cate defends employers against discrimination and workplace claims and advises businesses in the restaurant and hospitality industry on employment issues. Cate has been named a Rising Star by “Virginia Super Lawyers” since 2015 and was honored as a “Legal Elite” by Virginia Business magazine. Cate graduated magna cum laude from Virginia Tech and received her J.D. from Liberty University.
