    PAYSTUBS FOR VIRGINIA EMPLOYEES

                  Effective January 1, 2020, Virginia law will require employers to provide employees with a paystub or online accounting on each regular pay date. Current Virginia law requires employers to provide employees with “a written statement of the gross wages earned by the employee during any pay period and the amount and purpose of any deductions therefrom,” and only upon request of the employee.  Under the new law, a written statement in the form of a paystub or online accounting must show the following:

    • the name and address of the employer,
    • the number of hours worked during the pay period,
    • the rate of pay, the gross wages earned by the employee during the pay period, and the amount and purpose of any deductions.

                An employee engaged in agricultural employment including agribusiness and forestry is entitled to receive, upon request, a written statement of the gross wages earned by the employee during any pay period and the amount and purpose of any deductions.

                Another portion of the same statute remains unchanged, and continues to prohibit an employer from withholding any part of the wages or salaries of any employee except for payroll, wage or withholding taxes or in accordance with law, without the written and signed authorization of the employee. Employers must be careful to heed this prohibition, as the Virginia Department of Labor and Industry is vigilant in enforcing it.
