    TOPIC: Drug Testing: Navigating the New Reality

    The presentation will cover ways the national opioid crisis, medical marijuana, and drug legalization are more than headline news. These issues affect employers across Virginia every day.  How does the ADA apply to drug addiction and rehabilitation? What should you do if an employee tests positive for marijuana after traveling to a state where it's legal?

    This session will review the federal and state laws that apply to drug testing, with a large focus on reasonable suspicion testing, as well as the options available to employers such as EAPs, rehabilitation referrals, and last-chance agreements. Real-world cases and hypothetical scenarios are included to demonstrate the issues in play.

    Speakers:

    Patice L. Holland, a principal in Woods Rogers’ Roanoke office, is an attorney with diverse litigation practice and experience. She focuses primarily on employment litigation defense, intellectual property, transportation law (FELA, SAA, LIA), general civil and commercial litigation, real estate and commercial and residential landlord-tenant litigation, and insurance defense.

    Patice handles cases involving breach of contract, the False Claims Act, eminent domain, trademark and copyright law, commercial and residential lease disputes and landlord- tenant litigation, and professional malpractice defense. Patice also represents clients regarding labor/management relations, discrimination, ERISA and FELA. She counsels and trains on human resources issues regularly. She has extensive experience litigating cases in state and federal court as well as in mediation. Through her multifaceted litigation experience, Patice has garnered extensive knowledge in the areas of defending witness and document subpoenas and FOIA (Freedom of Information Act). She has provided training to local community services boards (CSBs) on FOIA, as well as Conflict of Interest and Board Fiduciary Responsibility.

    Patice is a member of the Virginia Lawyers Weekly 2016 group of Up and Coming attorneys. She is also the Roanoke Bar Association’s Young Lawyer of the Year for 2016. Virginia Super Lawyers selected her as a “Rising Star” in 2015 and 2016. She was awarded the Rev. F.E. Alexander Award for Excellence in Business by the Roanoke Chapter of the Urban Professional League (UPL) in 2014 and the “Drum Major for Justice” award by the Southern Christian Leadership Conference (SCLC) in 2018. Patice was also selected in 2019 for Virginia Lawyer’s Weekly’s inaugural class of “Influential Women of Law.”

    Prior to joining Woods Rogers in 2007, Patice was a licensed mediator, certified by the Supreme Court of Virginia. She also worked as a diversity fellow/law clerk at Carlton Fields P.A. in Tampa, Fla., where she co-authored Compendium of State Timeshare Law: Kentucky, published by the American Bar Association. She also served as a judicial intern for the Hon. Donald Horrox and the Hon. Patrick Caddell of the Sixth Judicial Circuit in Pinellas County, Fla.

    In the community, Patice serves as a board member and legal counsel for the Miss Virginia Pageant, Inc. She is chair of the Agency Funding Advisory Committee for arts and cultural organizations for the City of Roanoke. The Roanoke City Council appointed Patice to the board of the Roanoke Cultural Endowment Fund and the Roanoke Arts Commission.

     

    Leah M. Stiegler is a member of the firm’s Labor and Employment and Litigation practice groups. Leah’s employment practice focuses on helping employers comply with various employment laws, defending related employment actions with the Equal Employment Opportunity Commission and in state or federal court, conducting workplace trainings and board trainings, guiding employers through workplace investigations, and working with employers regarding collective bargaining and grievances/arbitrations.

    A Virginia native, Leah began her career at Woods Rogers as a summer associate in 2014 and joined the firm after completing a judicial clerkship with the Honorable Lawrence R. Leonard, U.S. Magistrate Judge for the Eastern District of Virginia, where she gained extensive experience in handling pretrial motions, discovery disputes, and settlement conferences.

    Leah earned her law degree from the University of Richmond School of Law, where she graduated cum laude and was a member of the Order of the Coif. She also served on the executive board of the University of Richmond Law Review. While in law school, Leah interned with the Honorable Kevin R. Huennekens, U.S. Bankruptcy Court.

    Leah earned the Pro Bono Certification Award for completing over 120 hours of pro bono service and public interest work for her time working with the Legal Aid Justice

    Center in Richmond, Va., the law school’s Immigration Clinic, and the Charlottesville Public Defender’s Office. Leah graduated summa cum laude from Virginia Tech, where she earned two degrees: A B.S. in Environmental Policy and Planning, and a B.A. in Spanish.

    Leah believes strongly in the values of youth athletics and is the head coach of The Bosses, a youth basketball team for girls in the City of Roanoke. Leah is a board member for Virginia Amateur Sports, Inc., a non-profit organization that promotes physical fitness and healthy lifestyles and runs the Virginia Commonwealth Games—the largest multi-sport festival held in Virginia each year.  Leah also serves as an Athletic Director on the Greater Southwest Athletic Association Board of Directors.
